On April 26, you requested an opinion from this office concerning a definition of the words "commanding officer", as contained in Senate Bill 74 which permits licensing of military personnel.
In the case of In re Cain, 84 F. 788, these words were construed to mean "the person who is in command of the fleet, squadron or garrison". Thus, "commanding officer", as used in this Act, must be the person who is the commander of the major unit, the garrison or base to which the person is attached.
