WHEREAS the Canada Industrial Relations Board (the Board), by order no. 9569‑U dated November 6, 2008, certified the Canadian Union of Public Employees (CUPE) as the bargaining agent for a unit of employees of El Al Israel Airlines Ltd. comprising:

all security employees employed by El Al Israel AirLines Ltd. (EL AL) at the Lester B. Pearson International Airport, excluding the chief of Security and the general manager.

AND WHEREAS, on or about October 31, 2011, the CUPE and the United Steel, Paper and Forestry, Rubber, Manufacturing, Energy, Allied Industrial and Service Workers International Union (United Steelworkers) (USW) entered into a memorandum of agreement concerning a transfer of jurisdiction from CUPE to USW with respect to the above-noted bargaining unit;

AND WHEREAS the Board has received an application from the applicant, pursuant to section 18 of the Canada Labour Code (Part I–Industrial Relations), seeking to amend order no. 9569‑U by replacing CUPE as the certified bargaining agent and updating the bargaining unit description;

AND WHEREAS the certified bargaining agent and the employer are not opposed to this application;

AND WHEREAS, following investigation of the application and consideration of the submissions of the parties concerned, the Board has determined that it is appropriate to grant the application.

NOW, THEREFORE, the Board hereby declares that the United Steel, Paper and Forestry, Rubber, Manufacturing, Energy, Allied Industrial and Service Workers International Union (United Steelworkers) is the bargaining agent for a bargaining unit comprising:

all employees of the security department of El Al Israel Airlines Ltd. in Canada (“ASO”), excluding the security manager and the administrative assistant.
