CONSENT ORDER

[1]       In the Condominium Authority Tribunal’s (CAT) online dispute resolution system, the Parties agreed to settle this case in Stage 2 - Mediation. This mediation started on February 04, 2025, and ended on February 20, 2025.

[2]       Under Rule 34.3 of the CAT’s Rules of Practice, the CAT can close a case in Stage 2 - Mediation if the Parties agree to the CAT making a consent order that resolves the dispute.

[3]       With the consent of the Parties, the CAT orders that this case has been resolved, based upon the terms and conditions set out in this consent order.

[4]       The Applicant requested the following five (5) records from the Respondent on November 05, 2024:

01.    Record of owners and mortgagees

02.    Most recent approved financial statements

03.    Minutes of Board meetings held within the last 12 months - December 2023 to November 2024

04.    Shared facility Minutes December 2023 - November 2024

05.    Shared facilities most recent financial statement

ORDER

[5]       The Respondent needs to provide the above requested records to the Applicant. During the Stage 2 - Mediation, the Respondent provided the above requested records to the Applicant.

[6]       The Respondent also provided the Board Response to the Applicant.

[7]       The Respondent needs to reimburse the Applicant with $75 for the filing fee of this application. Both parties confirmed that the Respondent reimbursed the Applicant with $75 for the filing fee of this application.

COMPLIANCE

[8]       If any of the Parties fails to comply with any of the terms of this order, it may be enforced through the Ontario Superior Court of Justice.
