DATE:
January 21, 2025
CASE:
2024-00775SA

Citation: Cangiano v. Metropolitan Toronto Condominium Corporation No. 962, 2025 ONCAT 11

Order under section 1.47 of the Condominium Act, 1998.

Member: Ian Darling, Chair

The Applicant,
Janet Cangiano
Self-Represented

The Respondent,
Metropolitan Toronto Condominium Corporation No. 962
Represented by Justin Murray, Agent

Hearing: Written Online Hearing – January 13, 2025 to January 21, 2025

REASONS FOR DECISION

[1]       The parties settled a case with a Settlement Agreement. One of the terms required the Respondent pay the Applicant $75.00. The deadline was December 12, 2024. When the Respondent did not pay the fee, the Applicant filed a case with the Tribunal seeking an order requiring the Respondent to comply with the Agreement.

[2]       The Respondent joined this case, but did not make any submissions. I am satisfied that they were aware of the case and had enough time to respond to the issues in dispute.

[3]       The Respondent has not complied with the Agreement. I will order the Respondent to comply with the Agreement and reimburse the $75.00. The Applicant paid $125.00 to file this CAT case. I will order the Respondent to reimburse this cost.

A.        ORDER

[4]       The Tribunal Orders the Respondent to pay $200 to the Applicant within 30 days of this order.
