DISMISSAL ORDER

[1]       The case is dismissed under Rule 19.1 of the CAT’s Rules of Practice. The issues in dispute have already been adjudicated in a CAT case. The CAT proposed to dismiss the case and invited submissions from the Applicant. The Applicant did not respond.

[2]       In Bates v. Cannon et al., 2023 ONCAT 118 the CAT ordered that “within 60 days of (the) decision, Mr. Cannon shall modify or replace his outdoor fixture so that the light is subtle and diffuse.”

[3]       The current Application seeks an order from the Tribunal about the same issues. The appropriate venue to enforce a CAT order is the Superior Court of Justice.
