DATE: April 19, 2023
CASE:
2022-00742R

Citation: Nurmi v. York Condominium Corporation No. 43, 2023 ONCAT 59

Order under Rule 4 of the Condominium Authority Tribunal’s Rules of Practice.

Member: Marc Bhalla, Member

The Applicant,
Peter Nurmi
Self-Represented

The Respondent,
York Condominium Corporation No. 43
Represented by Matthew Varao, Paralegal

MOTION ORDER

[1]       The Applicant has filed two cases against the Respondent, Case 2022-00632R and this case. Both are records cases that I have been assigned to adjudicate.

[2]       As the issues of the two cases are similar and Case 2022-00632R is in the early stages of the hearing process, I proposed merging the two cases in the interest of efficiency and fairness. Rule 18.2 of the Tribunal’s Rules of Practice allows for this. Both parties agreed to merge the cases.

ORDER

[3]       The Tribunal orders that:

1.         This case be closed and merged with Case 2022-00632R. I will provide the parties with instructions on the Tribunal’s CAT-ODR system about how to affect the merger.
