CONSENT ORDER
[1] Using the Condominium Authority’s Tribunal online system, the Applicant, Constance Allen, and the Respondent, WCC#45 (Wentworth Condominium Corporation #45), have both agreed to settle this case.
[2] CAT Member Marc Bhalla therefore orders that this case has been resolved without a hearing, based on the following terms and conditions:
ORDER
[3] Wentworth
Condominium Corporation No. 45 agrees to provide Constance Allen with the
following within ten (10) business days at no cost:
1.
List of unit owners which includes names,
unit numbers and addresses for service;
2.
Documentation surrounding the pool incident
of on or around August 8, 2017, including:
(i) Board minutes of August 15, 2017;
(ii) Video footage surrounding the pool
incident;
3.
Documentation surrounding the pool incident
of on or around August 8, 2017, including:
(i) Superintendent’s memorandum;
(ii) Sign-in sheet;
(iii) Statement from witnesses;
(iv) Board minutes of January 16, 2018;
(v) Video footage surrounding the pool
incident;
4.
Internal policy pertaining to $25 late
charges; and
5. Written confirmation of the directors who have completed their mandatory training. Both users agree to bear their own costs for participating in this case.
COMPLIANCE
[4] If either Constance Allen or WCC#45 (Wentworth Condominium Corporation #45) fails to comply with any of the terms of this order, it may be enforced by through the Ontario Superior Court of Justice.
