CONSENT ORDER

Using the Condominium
Authority’s Tribunal online system, the Applicant, Jack Gale, and the
Respondent, Halton Condominium Corporation No. 61, have both agreed to settle
this case.
[2] CAT Member Angelique Palmer therefore orders that this case has been resolved without a hearing, based on the following terms and conditions:

The Applicant and the
Respondent have agreed to settle this matter under the following terms:

The Respondent will produce the General Ledger,
expenses only, for the 2017 fiscal year for both operating and reserve funds;

The records will total fifty-three (53 pages).
The cost associated for the records request are to be paid by the
Applicant/Owner and a document request form signed by the Applicant and
Respondent confirming payment and the documents to be provided. The cost to
produce the documents to the Applicant is $120.10, which is broken down as
follows:
a. $109.50 for the labour associated with the retrieval, photocopying, and redacting of the record;
b. $30.00 per hour for management’s labour as per the recent case law released by the CAT;
c. Three (3) minutes per page (x 53 pages), for review, redacting (totaling 2.65 hours) and an hour (1) to double check the redacting to ensure no confidential information of any category described in subsection 55(4) of the Act is disclosed;
d.
Photocopying fee of $0.20 per page x 53 pages,
totalling $10.60.

The Applicant will abandon the Application, Case
#2018-00211R - Jack Gale & Halton Condominium Corporation No. 61, filed
with the Condominium Authority Tribunal.

The Respondent shall produce the documents
within 21 days after payment received as described in paragraph 2.
COMPLIANCE
[8] If either Jack Gale or Halton Condominium Corporation No. 61 fails to comply with any of the terms of this order, it may be enforced by through the Ontario Superior Court of Justice.
