ORDER SETTING ASIDE ORDER |
Public School Employees of Washington filed a petiion seeking clarification of an existing bargaining unit of classified employees of Sedro Woolley School District No. 101 on February 25, 1981. At issue was the bargaining unit status of substitute classified employees. A formal hearing was conducted on June 8, 1981, with both parties submitting closing briefs. In Decision No. 1351 (PECB, 1982), issued March 30, 1982, the existing bargaining unit status of substitute employees was left unchanged because the parties had contractually agreed to exclude substitutes and petitioner could not show any change of circumstances requiring inclusion of substitutes in the existing bargaining unit.
On April 13, 1982, petitioner filed a motion and supporting affidavits, requesting that the hearing be reopened to present additional testimony concerning a substantial change of circumstances occurring since the close of the original hearing in the case. Specifically, petitioner contends that the parties signed a subsequent collective bargaining agreement reserving the issue of substitute employee bargaining unit status to the Public Employment Relations Commission. Examination of the petition and affidavits indicates that the order issued on March 30, 1982 should be withdrawn pending the determination of the issue presented in the petition. Accordingly it is therefore
ORDERED
1. The order issued in Decision No. 1351 (PECB, 1982) is hereby set aside pending review of the motion filed by Public School Employees of Washington on April 13, 1982.
2. The employer shall have fourteen (14) days following the issuance of this order to reply to the petition requesting additional hearing.
