DECISION OF COMMISSION

Gene Minetti, appeared pro se.

Bogle and Gates, by Peter M. Anderson, Attorney at Law, appeared on behalf of the respondent.

On March 1, 1988, Examiner Kenneth J. Latsch issued his findings of fact, conclusions of law and order in the above-entitled matter, dismissing the complaint on the merits. On March 31, 1988, Gene Minetti filed a petition for review under cover of a letter which stated, in part:

I did not recieve (sic) your decision #2661-A until mid-March 1988. This Petition for Review will still reach you within the thirty day period although past the twenty day period.

I hope you will still review it.

The employer responded by letter on April 6, 1988, noting that the petition for review was untimely under WAC 391-45-350 and asking that it be dismissed.

Consistent with longstanding Commission policy and precedent, the petition for review must be dismissed. See: City of Seattle, Decision 2230-A (PECB, 1985); Seattle Public Health Hospital (American Federation of Government Employees), Decision 1781-B (PECB, 1984); Port of Ilwaco, Decision 970-A (PECB, 1980); Spokane School District, Decision 310-A (EDUC, 1978).

NOW, THEREFORE, it is

ORDERED

The petition for review is dismissed and the matter is closed.
