Executive Director Marvin L. Schurke issued his preliminary ruling on amended complaint in the above-entitled matter on January 15, 1986 dismissing certain of the allegations of the complaint. On February 5, 1986, the complainant filed a petition for review.

The petition for review was filed one day late and, therefore, was untimely. Consistent with longstanding Commission policy and precedent, the petition for review must be dismissed. See: Seattle Public Health Hospital (American Federation of Government Employees), Decision 1781-B (PECB, 1984); Port of Ilwaco, Decision 970-A (PECB, 1980); Spokane School District, Decision 310-A (EDUC, 1978).

The petition for review is dismissed and the matter is remanded to the Examiner to conduct further proceedings subject to Chapter 391-45 WAC.
