Summary of Decision: The Union filed a petition to add Confidential Strategy Planner titles to Certification No. 3-88, the Staff Analysts bargaining unit. Based on a stipulation, the Board added employees in the Confidential Strategy Planner (Buildings) and Confidential Strategy Planner (Kings County DA) titles to the bargaining unit, with the exception of three positions that are designated managerial or confidential. ORDER AMENDING CERTIFICATION On August 12, 2022, the Organization of Staff Analysts (“Union”) filed a petition, docketed as AC-1699-22, seeking to add the following titles to Certification No. 3-88, the Staff Analysts bargaining unit: Confidential Strategy Planner (Buildings) (Title Code No. 54748), Confidential Strategy Planner (Finance) (Title Code No. 54744), Confidential Strategy Planner (Fire Department) (Title Code No. 54749), Confidential Strategy Planner (Kings County DA) (Title Code No. 54742), and Confidential Strategy Planner (NYCERS) (Title Code No. 54736). In a separate proceeding, docketed as VR-1700-22, the City of

New York (“City”) proposed to voluntarily recognize the Union as the bargaining representative of three of these titles. As a result of the voluntary recognition, Certification No. 3-88 was amended to add Confidential Strategy Planner (Finance), Confidential Strategy Planner (Fire Department), and Confidential Strategy Planner (NYCERS). See OSA, 15 OCB2d 29 (BOC 2022). On April 10, 2023, the Union and the City signed a stipulation of settlement in which they agreed that employees in the Confidential Strategy Planner (Buildings) title are eligible for collective bargaining, with the exception of the Workforce Planning Manager position, currently held by Jennifer Munoz, which is designated confidential, and the Press Secretary position, currently held by Andrew Rudansky, which is designated managerial. They further agreed that employees in the Confidential Strategy Planner (Kings County DA) title are eligible for collective bargaining, with the exception of the Senior Advisor for Communications and Policy position, currently held by Yarden Carmon, which is designated managerial. NOW, THEREFORE, pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining Law (New York City Administrative Code, Title 12, Chapter 3), it is hereby ORDERED that Certification No. 3-88 (as previously amended) be, and the same hereby is, further amended to add employees in the Confidential Strategy Planner (Buildings) (Title Code No. 54748), with the exception of the Workforce Planning Manager position, which is designated confidential, and the Press Secretary position, which is designated managerial; and it is futher
