SEIU, Local 621, 13 OCB2d 14 (BOC 2020) (Rep) (Docket No. AC-1666-19) Summary of Decision: The Union filed a petition to add the title Assistant Commissioner (FD) to Certification No. 55-70, the Supervisor of Mechanics (M.E.) bargaining unit. The parties stipulated that the Assistant Commissioner (FD) in the Division of Fleet Operations would be moved to a newly created title of Executive Director of Fleet Operations (FD), which is eligible for collective bargaining. Accordingly, the Board added the Executive Director of Fleet Operations (FD) title to the bargaining unit. (Official decision follows.) ____________________________________________________________ OFFICE OF COLLECTIVE BARGAINING BOARD OF CERTIFICATION In the Matter of the Certification Proceeding -between- SERVICE EMPLOYEES INTERNATIONAL UNION, LOCAL 621, Petitioner, -and- FIRE DEPARTMENT, CITY OF NEW YORK, Respondent. ____________________________________________________________ ORDER AMENDING CERTIFICATION On July 26, 2019, Service Employees International Union, Local 621 (“Union”) filed a petition, docketed as AC-1666-19, requesting that employees in the title Assistant Commissioner (FD) (Title Code No. 95039) be added to Certification No. 55-70, the Supervisor of Mechanics (M.E.) bargaining unit. On June 8, 2020, the parties signed a stipulation of settlement in which they agreed that the City would establish the title Executive Director of Fleet Operations (FD) (Title Code No. 9503B) and the Union agreed to withdraw its petition with prejudice as to the Assistant Commissioner (FD) title except
13 OCB2d 14 (BOC 2020) 2 for positions in the Division of Fleet Operations. The parties agreed that the Executive Director of Fleet Operations (FD) title is eligible for collective bargaining and that Mark Aronberg, the incumbent Assistant Commissioner (FD) in the Division of Fleet Operations, will be moved to the newly created title and given the in-house position of Executive Director. The parties jointly requested that the Board of Certification add the Executive Director of Fleet Operations (FD) title to the Unions bargaining unit. NOW, THEREFORE, pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining Law (New York City Administrative Code, Title 12, Chapter 3), it is hereby ORDERED that Certification No. 55-70 (as previously amended) be, and the same hereby is, further amended to add the title Executive Director of Fleet Operations (FD) (Title Code No. 9503B).
