74 OCB 5 (BOC 2004) OFFICE OF COLLECTIVE BARGAINING BOARD OF CERTIFICATION ----------------------------------------------------------------X In the Matter of DISTRICT COUNCIL 37, AFSCME, AFL-CIO, Petitioner, Decision No. 5-2004 Docket No. AC-17-04 -and-NEW YORK CITY HEALTH AND HOSPITALS CORPORATION, Respondent. ----------------------------------------------------------------X ORDER AMENDING CERTIFICATION On October 7, 2004, District Council 37, AFSCME, AFL-CIO (“DC 37”), filed a petition pursuant to § 1-02(u) of the Rules of the Office of Collective Bargaining (Rules of the City of New York, Title 61, Chapter 1) requesting that the title, Client Navigator, Levels I and II (Title Codes 985510 and 985520), be accreted to Certification No. 46C-75, a bargaining unit that includes such titles as Call Center Representative, Customer Communications Specialist (OTB), and Clerical Associate. The New York City Health and Hospitals Corporation raised no objection to the inclusion of these employees in DC 37's bargaining unit pursuant to Certification No. 46C-75. The Board of Certification is satisfied that no evidence was presented to rebut DC 37's assertion that Client Navigators, Levels I and II, have a sufficient community of interest with the members of the certified bargaining unit. NOW, THEREFORE, pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining Law (New York City Administrative Code, Title 12,
Decision No. 3-2004 2 Chapter 3), it is hereby ORDERED that Certification No. 46C-75 (as previously amended) be, and the same hereby is, further amended to add the title: Client Navigator, Levels I and II (Title Codes 985510 and 985520), subject to existing contracts, if any.
