LEEBA, 9 OCB2d 14 (BOC 2016) (Rep) (Docket No. RU-1620-16) Summary of Decision: LEEBA filed a petition to represent the School Safety/Traffic bargaining unit, represented by OSA. As the petition was timely and supported by a sufficient showing of interest, the Board conducted an election to ascertain the employees wishes as to their union representation. Based on the results of the election, OSA remains the exclusive bargaining representative of the bargaining unit. (Official decision follows.) DECISION On February 5, 2016, the Law Enforcement Employees Benevolent Association (“LEEBA”) filed a petition to represent employees in the titles Administrative Traffic Enforcement Agent (Title Code No. 10042), Associate Supervisor of School Security (Title Code No. 60821), and Administrative School Safety Manager (Title Code No. 10083), represented by the Organization of Staff Analysts (“OSA”) in Certification No. 9-2001 (“School Safety/Traffic bargaining unit). As the petition was timely and supported by a sufficient showing of interest, the
9 OCB2d 14 (BOC 2016) 2 Board conducted an election to determine whether the employees at issue wished to be represented for the purposes of collective bargaining by LEEBA, OSA, or neither. See § 12-309(b)(2) of the New York City Collective Bargaining Law (New York City Administrative Code, Title 12, Chapter 3). The election was held by phone and on-line ballot in accordance with § 1-02 of the Rules of the Office of Collective Bargaining (Rules of the City of New York, Title 61, Chapter 1) for employees in the School Safety/Traffic bargaining unit. The ballots were counted on May 26, 2016. The majority of employees casting valid ballots selected OSA as their representative for collective bargaining. No party filed objections to the election. Accordingly, OSA remains the exclusive bargaining representative of the School Safety/Traffic bargaining unit in Certification No. 9-2001. Dated: June 16, 2016 New York, New York SUSAN J.
