Summary of Decision: The City of New York filed a petition to amend Local 375, Civil Service Technical Guild, District Council 37s Certification No. 26-78 to delete the titles Assistant Surveyor Trainee and Assistant Surveyor and add assignment levels to the existing title of Surveyor. OCBs records were administratively amended to reflect the addition of the levels. The Board amended the certification to delete the vacant titles. (Official decision follows.) _________________________________________________________________ OFFICE OF COLLECTIVE BARGAINING BOARD OF CERTIFICATION In the Matter of the Certification Proceeding -between-CITY OF NEW YORK, Petitioner, -and-LOCAL 375, CIVIL SERVICE TECHNICAL GUILD, DISTRICT COUNCIL 37, AFSCME, AFL-CIO, Respondent. __________________________________________________________________ ORDER AMENDING CERTIFICATION On May 1, 2006, the City of New York (“City”) filed a petition to amend Certification No. 26-78, a bargaining unit represented by Local 375, Civil Service Technical Guild, District Council 37, AFSCME, AFL-CIO (“Union”), to delete the titles of Assistant Surveyor Trainee (Title Code No. 21005) and Assistant Surveyor (Title Code No. 21010) and to add Levels I-A, I-B, II, and III to the existing title of Surveyor (Title Code No. 21015). The Union opposed the petition on the grounds that incumbents remained in the Assistant Surveyor Trainee and Assistant Surveyor titles and that the Union would naturally represent all levels of the Surveyor title, which is already

On June 2, 2006, the Director of Representation notified the parties that the Office of Collective Bargainings records had been updated to reflect the addition of Levels I-A, I-B, II, and III to the Surveyor title and that the Assistant Surveyor Trainee and Assistant Surveyor titles could not be deleted until they were vacant. Our investigation now shows that there are no employees currently serving in the Assistant Surveyor Trainee and Assistant Surveyor titles. NOW, THEREFORE, pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining Law (New York City Administrative Code, Title 12, Chapter 3), it is hereby ORDERED that Certification No. 26-78 (as previously amended) be, and the same hereby is, further amended to delete the titles Assistant Surveyor Trainee (Title Code No. 21005) and Assistant Surveyor (Title Code No. 21010).
