Summary of Decision: The New York City Health and Hospitals Corporation filed a petition to amend Local 1199, National Health and Human Services Union, SEIUs Certification No. 66-78 to delete the title Associate Pharmacist, Levels I to IV, and add the title Health System Pharmacist, Levels I to III. The Board amended the certification to add the Health System Pharmacist title and held that the Associate Pharmacist title will be deleted when the title is vacant. (Official decision follows.) _________________________________________________________________ OFFICE OF COLLECTIVE BARGAINING BOARD OF CERTIFICATION In the Matter of the Certification Proceeding -between-NEW YORK CITY HEALTH AND HOSPITALS CORPORATION, Petitioner, -and-LOCAL 1199, NATIONAL HEALTH AND HUMAN SERVICES UNION, SERVICE EMPLOYEES INTERNATIONAL UNION, Respondent. __________________________________________________________________ ORDER AMENDING CERTIFICATION On December 13, 2006, the New York City Health and Hospitals Corporation (“HHC”) filed a petition to amend Certification No. 66-78, a bargaining unit represented by Local 1199, National Health and Human Services Union, Service Employees International Union (“Union”), to delete the title Associate Pharmacist, Level I (Title Code No. 985110), Level II (Title Code No. 985120), Level III (Title Code No. 985130), and Level IV (Title Code 985140) and to add the title Health System Pharmacist, Level I (Title Code No. 930010), Level II (Title Code No. 930020), and Level III (Title Code No. 930030) to reflect the reclassification of these titles. Notice of this petition was
Decision No. 3-2007 2 given to the public and the Union, and no objections or responses were filed. Our investigation shows that there are incumbents currently serving in the Associate Pharmacist title. In order not to deprive these employees of union representation, the title will be deleted upon notification from HHC that the title is vacant. NOW, THEREFORE, pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining Law (New York City Administrative Code, Title 12, Chapter 3), it is hereby ORDERED that Certification No. 66-78 (as previously amended) be, and the same hereby is, further amended to add the title Health System Pharmacist, Level I (Title Code No. 930010), Level II (Title Code No. 930020), and Level III (Title Code No. 930030), subject to existing contracts, if any; and it is further ORDERED that Certification No. 66-78 (as previously amended) be further amended to delete the title Associate Pharmacist, Level I (Title Code No. 985110), Level II (Title Code No. 985120), Level III (Title Code No. 985130), and Level IV (Title Code 985140) when that title becomes vacant.
