RU-256-71 -and-DISTRICT COUNCIL 9 OF NEW YORK CITY, INTERNATIONAL BROTHERHOOD OF PAINTERS AND ALLIED TRADES, AFL-CIO, and LOCAL 246, SERVICE EMPLOYEES INTERNATIONAL UNION, AFL-CIO, Joint Intervenors -and-THE CITY OF NEW YORK AND RELATED PUBLIC EMPLOYERS - - - - - - - - - - - - - - - - - - - X DECISION, ORDER, AND AMENDED CERTIFICATION On November 5, 1971 the Board of Certification issued Decision No.75-71, directing an election among a unit of Painters, Foremen Painters, House Painters, Foremen House Painters, Sign Painters, and Letterers, employed by the City of New York and related public employers subject to the jurisdiction of the Board of Certification, to determine whether they desired to be represented for purposes of collective bargaining by Local 237, International Brotherhood of Teamsters; or by District Council 9 of New York City, International Brotherhood of Painters and Allied Trades, AFL-CIO, and Local 246, Service Employees International Union, AFL-CIO, jointly.
Decision No-84-71 Docket No. RU-256-71 2. Subsequently, Local 237 requested that its name be removed from the ballot. This request was granted. Accordingly, the election, which had been scheduled for December 8, 1971, was canceled. Based upon this withdrawal, District Council 9 and Local 246 consented to joint certification for the unit previously found appropriate by this Board (Decision No.75-71). Representative Status District Council 9 had been previously certified (Decision No.37-69) as exclusive representative of a unit of Painters, House Painters, Foremen Painters, and Foremen House Painters. Our investigation shows that a majority of Sign Painters and Letterers have authorized check-off of dues in behalf of Local 246. Accordingly, we shall rescind the Direction of Election herein and add the Sign Painters and Letterers to Certification No.37-69. 0 R D E R Pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining Law, it is hereby

ORDERED that the direction of election contained in Decision No.75-71 be, and the same hereby is, rescinded; and it is further ORDERED that Certification No.37-69 be, and the same hereby is, amended to include the titles of Sign Painter and Letterer; and, as amended, such unit shall consist of Sign Painters, Letterers, Painters, House Painters, Foremen Painters, and Foremen House Painters; and it is further ORDERED that Certification No.37-69 be, and the same hereby is, further amended to change the name of the certified representative to"District Council 9 of New York City, International Brotherhood of Painters and Allied Trades, AFL-CIO, and Local 246, Service Employees International Union, AFL-CIO, jointly."
