RU-208-70 -and-THE CITY OF NEW YORK AND RELATED PUBLIC EMPLOYERS, Respondent. - - - - - - - - - - - - - - - - - - X DECISION AND ORDER Civil Service Forum, Local 300, S.E.I.U., AFL-CIO (herein called Petitioner), filed its petition herein on July 14, 1970, requesting to amend Certification CWR-23/67 by deleting the titles of Assistant Bacteriologist, Bacteriologist and Senior Bacteriologist (including specialty), and substituting the reclassified titles of Assistant Microbiologist, Microbiologist (including specialties), Senior Microbiologist (including specialties), and Principal Microbiologist. The cited Certification, which also covers Junior Bacteriologist, is held by Petitioner. Upon consideration of its investigation, and after due deliberation, the Board of Certification issues the following decision:
Decision No.24-71 Docket No. RU-208-70 2. I. Undisputed Matters. It is undisputed, and we find and conclude, that Petitioner is a public employee organization in fact and within the meaning of the New York City Collective Bargaining Law. II. The Appropriate Unit and Representative Status: The City Civil Service Commission deleted from the classification the titles of Assistant Bacteriologist, Bacteriologist and Senior Bacteriologist (including specialty) and provided for the reclassification of incumbents in these titles to equivalent levels of the newly created titles of Assistant Microbiologist, Microbiologist (including specialties), and Senior Microbiologist (including specialties). The Commission also classified the new title of Principal Microbiologist. At this time, the reclassification of employees in the former bacteriologist titles to the microbiologist titles has not been completed in all employing agencies. As there are employees serving in the previously certified titles, we do not find it appropriate at this time to delete these titles from the unit.
Decision No.24-71 Docket No. RU-208-70 3. An additional title, Senior Biologist (Cancer Research), involves duties and responsibilities similar to those of the petitioned titles. Neither Petitioner nor the City has objected to inclusion of this title in the unit. Therefore, we find and conclude that Senior Biologist (Cancer Research) and the petitioned titles should be added to Certification CWR-23/67. It appears from our investigation that a majority of Assistant Microbiologists, Microbiologists (including specialties), Senior Microbiologists (including specialties), Principal Microbiologists and Senior Biologist (Cancer Research) have authorized dues check-off in behalf of Petitioner. Accordingly, we shall amend Certificate CWR-23/67 to include said titles. 0 R D E R Pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining Law, it is hereby
