L. 371, SSEU,72 OCB 6 (BOC 2003) [6-2003 (Cert Correction)] OFFICE OF COLLECTIVE BARGAINING BOARD OF CERTIFICATION ----------------------------------------------------- X In the Matter of THE CITY OF NEW YORK, Petitioner, Decision No. 6-2003 CORRECTED -and-Case No. RE-176-03 LOCAL 371, SOCIAL SERVICES EMPLOYEES UNION, DISTRICT COUNCIL 37, AFSCME, AFL-CIO, Respondents. -----------------------------------------------------X ORDER AMENDING CERTIFICATION On July 23, 2003, the City of New York filed a petition pursuant to § 1-02(d) and (u) of the Rules of the Office of Collective Bargaining (Rules of the City of New York, Title 61, Chapter 1), requesting that the titles Consultant (Mental Health Standards and Services)(Title Code 51000) and Senior Consultant (Mental Health Standards and Services)(Title Code 54810) be deleted from Certification No. 37-78, a bargaining unit represented by District Council 37, AFSCME, and that the title Special Consultant (Mental Health Standards and Services), Levels I and II (Title Code 51001) be added to that same certification. The City asserted that employees in the deleted titles were being reclassified into the new title Special Consultant (Mental Health Standards and Services), Levels I and II. Notice of this petition was given to the public and District Council 37. No objections or responses were filed. The Board is satisfied that as of June 12, 2002, the New York City Department of Citywide Administrative Services deleted the titles – Consultant (Mental Health
Decision No. 6-2003 Standards and Services) (Title Code 51000) and Senior Consultant (Mental Health Standards and Services) (Title Code 54810) – from the Classified Service of the City of New York and created the title Special Consultant (Mental Health Standards and Services), Levels I and II (Title Code 51001). The City has indicated that District Council 37 does not object to the inclusion of the new title its bargaining unit pursuant to Certification No. 37-78. NOW, THEREFORE, pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining Law (New York City Administrative Code, Title 12, Chapter 3), it is hereby ORDERED that Certification No. 37-78 (as previously amended) be, and the same hereby is, further amended to delete the titles: Consultant (Mental Health Standards and Services) (Title Code 51000) and Senior Consultant (Mental Health Standards and Services) (Title Code 54810); and further ORDERED that Certification No. 37-78 (as previously amended) be, and the same hereby is, further amended to add the title, Special Consultant (Mental Health Standards and Services), Levels I and II (Title Code 51001), subject to existing contracts, if any.
