Petitioner represents the titles: Administrative Assistant, Programmer, Attendant, Senior Clerk, among other titles at the Board of Elections, pursuant to Certification No. 45-71. Notice of this petition was given to the public and all interested parties. On April 11, 2003, the City of New York (“City”) advised the Director of Representation that it had no objection to Petitioner’s motion. The Board of Certification (“Board”) is satisfied that no evidence was presented to rebut Petitioner’s assertion that the new title – Trainer Assistant (Board of Elections) – has a sufficient community of interest with persons who are already members of the certified bargaining unit.
Decision No. 3-2003 2 NOW, THEREFORE, pursuant to the powers vested in the Board by the New York City Collective Bargaining Law (New York City Administrative Code, Title 12, Chapter 3) §§12-301 et seq., it is hereby ORDERED that Certification No. 45-71 (as previously amended) be, and the same hereby is, further amended to add the title, Trainer Assistant (Board of Elections) (Title Code 94524), subject to existing contracts, if any.
