City,70 OCB 4 (BOC 2002) [4-2002 (Cert Corr)] OFFICE OF COLLECTIVE BARGAINING BOARD OF CERTIFICATION ---------------------------------------------------------------X In the Matter of EMS SUPERIOR OFFICERS ASSOCIATION, Petitioner Decision No. 4-2002 -and-Docket No. RU-1234-98 THE CITY OF NEW YORK, Respondent ---------------------------------------------------------------X ORDER CORRECTING DECISION On December 5, 2001, this Board issued Decision No. 10-2001 wherein we found that certain employees holding the title Supervising Emergency Medical Service Specialist, Levels II and III (“SEMSS”)” were eligible for bargaining. That Decision describes the employees eligible for bargaining as those who are detailed to the positions Deputy Chief and Division Commander in the New York City Fire Department Bureau of EMS and certifies the EMS Superior Officers Association (“Petitioner”) as the bargaining representative of those employees. On January 24, 2002, Petitioner and the City jointly requested that the Boards Decision No.10-2001 be amended to accurately reflect the employees title and title code as Supervising Emergency Medical Service Specialist, detailed as Deputy Chief and Division Commanders, (Title Code M5035E).” The requested amendment is a correction of an inadvertant error in our December 5, 2001 Decision. The request asks that the Decision utilize the same description of the bargaining unit as was used in the underlying petition. Use of the requested description of the bargaining
Decision No. 4 -2002 unit is in no way inconsistent with the Boards December 5, 2001 conclusions. Accordingly, we hereby amend our Decision and issue a Corrected version reflecting the accurate description of the bargaining unit. ORDER Pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining law, it is hereby ORDERED, that the description of the bargaining unit sought and unit certified in Decision No. 10-2001 be changed to: Supervising Emergency Medical Service Specialists, detailed as Deputy Chiefs and Division Commanders, (Title Code M5035E); and it is further ORDERED, that the attached copy of the Corrected Decision and Order in Decision No. 10-2001 be, and hereby is substituted for the original version.
