AC-1-2001 NEW YORK CITY HEALTH AND : HOSPITALS CORPORATION : : ------------------------------------------------------X ORDER AMENDING CERTIFICATION On May 31, 2001, the Doctors Council (“Petitioner”) filed a Motion to Amend Certification pursuant to §1-02(v) of the Rules of the Office of Collective Bargaining (Rules of the City of New York, Title 61, Chapter 1), requesting to add the title Attending Dentist, Levels I, II, and III (Title Codes 970310, 970320, 970330) to its Certification No. 50-73. Petitioner represents the titles Attending Physician, Physician, Dentist, Senior Dentist, and City Dentist, among others, in Cert. No. 50-73. Certain individuals in the title Attending Physician are licensed dentists who provide dental care and services. In order to comply with the New York State Education Law, the Division of Human Resources of the New York City Health and Hospitals Corporation issued a Personnel Order (HHC 01/02) ordering that those persons serving in the title Attending Physician who are licensed dentists performing dental services will be reclassified to a newly created title – Attending Dentist, Levels I, II and III – by September 4, 2001.
Decision No. 8-2001 Page No.2 Docket No. AC-1-2001 Notice of this petition was given to the public and all interested parties, and no objections were filed. Upon investigation, the Board is satisfied that the new title – Attending Dentist – is merely a reclassification of persons who are already members of the certified bargaining unit, and persons serving in the new title will perform substantially the same duties and functions as those they were previously assigned. Therefore, the new title – Attending Dentist – is appropriately accreted to Certification No. 50-73 (as amended). NOW, THEREFORE, pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining Law- New York City Administrative Code, Chapter 3, §§12-301 et seq., it is hereby ORDERED that Certification No. 50-73 (as previously amended) be, and the same hereby is, further amended to add the title Attending Dentist Levels I, II, and III (Title Codes 970310, 970320, 970330), subject to existing contracts, if any.
