RU-1207-97 : ------------------------------------------------------X ORDER AMENDING CERTIFICATION On January 21, 1997, the City Employees Union, Local 237, International Brotherhood of Teamsters, AFL-CIO (the “Petitioner”) filed a Motion to Amendment Certification requesting to delete the titles of Junior Building Custodian (Title Code 80601), Assistant Building Custodian (Title Code 80605), Building Custodian (Title Code 80610), Senior Building Custodian (Title Code 80635), Supervisor of Building Custodians (Title Code 80660), and Senior Custodial Assistant (Title Code 82016) from Certification No. 67-78, and to add the title(s) Custodian - Assignment Levels I, II, III and IV (Title Code 80609) to the same Certification. At the time the Motion was filed, the Petitioner represented all employees in the titles of Junior Building Custodian, Assistant Building Custodian, Building Custodian, Senior Building Custodian, and Supervisor of Building Custodians; Local 300, Service Employees International Union represented the employees in the title of Senior Custodial Assistant. Upon investigation, the Board is satisfied that the parties undertook steps which effectuated the requested amendment prior to any action from the Board of Collective Bargaining. On or about April 16, 1997, the Department of Citywide Administrative Services deleted from the Classified Service of the City of New York the titles: Junior Building Custodian, Assistant Building Custodian, Building Custodian, Senior Building Custodian, Supervisor of Building Custodians and Senior Custodial Assistant, and created the new title(s) Custodian - Levels I through IV. In or around that same time, on notice to and without objection from Local 300, Service Employees International Union, the City of New York reclassified all those employees holding the deleted job titles into the new titles, and recognized the Petitioner as the exclusive bargaining representative of all the employees in the new title(s) Custodian - Levels I, II, III and IV. NOW, THEREFORE, pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining Law- New York City Administrative Code, Chapter 3, §§12-301 et seq., it is hereby ORDERED that Certification No. 67-78 (as previously amended) be, and the same hereby is, further amended nunc pro tunc to delete the titles of Junior Building Custodian (Title Code 80601), Assistant Building Custodian (Title Code 80605), Building Custodian (Title Code 80610), Senior Building Custodian (Title Code 80635), Supervisor of Building Custodians (Title Code 80660), and Senior Custodial Assistant (Title Code 82016), and add the title(s)
