City, 6 OCB 96 (BOC 1970) [Decision No. 96-70 (Cert.)] OFFICE OF COLLECTIVE BARGAINING BOARD OF CERTIFICATION In the Matter of CIVIL SERVICE FORUM, LOCAL 300, DECISION NO.96-70 S.E.I.U., AFL-CIO -and-DOCKET NO. RU-216-70 THE CITY OF NEW YORK AND RELATED PUBLIC EMPLOYERS DECISION AND ORDER Civil Service Forum, Local 300, S.E.I.U., AFL-CIO, filed its petition herein, on August 20, 1970. Upon consideration of its investigation and after due deliberation, the Board of Certification issues the following decision: I. Undisputed Matters It is undisputed, and we find and conclude, that Petitioner is a public employee organization in fact and within the meaning of the New York City Collective Bargaining Law. II. The Appropriate Unit Petitioner seeks to merge and consolidate its certifications 5 NYCDL No.93, covering Senior Office Appliance Operators, and CWR-102/67 covering Purchase Inspectors (including specialties) and Senior Purchase Inspectors (including specialties).

The City contends that there Is no community of interest between the units covered by the cited Certifications, and that a consolidated unit would be inappropriate. The Senior Office Appliance Maintainers are responsible for the repair and upkeep of office equipment. The Purchase Inspectors and Senior Purchase Inspectors examine goods and services purchased for the City to determine if purchase or contract specifications are fulfilled. As the duties, skills, and interests of the Senior Office Appliance Maintainers are substantially different from those of the purchase inspectors, we find that it would not effectuate the purposes of the statute to merge Certifications 5 NYCDL No.93 and CWR-102/67.
