City, 6 OCB 90 (BOC 1970) [Decision No. 90-70 (Cert.)] OFFICE OF COLLECTIVE BARGAINING BOARD OF CERTIFICATION In the Matter of CIVIL SERVICE FORUM, LOCAL 300 DECISION NO. 90-70 S.E.I.U., AFL-CIO -and-DOCKET NO. RU-199-70 THE CITY OF NEW YORK AND RELATED PUBLIC-EMPLOYERS DECISION AND CERTIFICATION Civil Service Forum, Local 300, S.E.I.U., AFL-CIO (herein called Petitioner), filed its petition herein on June 30, 1970, requesting that Certificate CWR-96/67, covering Laboratory Aides, be amended by adding the newly established titles of Laboratory Technician and Senior Laboratory Technician and by deleting the title of Laboratory Aide. Upon consideration of its investigation, and after due deliberation, the Board of Certification issues the following decision: I. Undisputed Matters It is undisputed, and we find and conclude, that Petitioner is a public employee organization in fact and within the meaning of the New York City Collective Bargaining Law. II. The Appropriate Unit and Representative Status Civil Service Commission Resolution No. 69-88, dated August 12, 1969, abolished the title of Laboratory Aide and classified the titles of Laboratory Technician and
DECISION NO. 010-70 DOCKET NO. RU-199-70 2 Senior Laboratory Technician in the Laboratory Technician Occupational Group. Employees in the title of Laboratory Aide were subsequently reclassified (CCSC Res. No. 70-2) to Laboratory Technicians. A third title in the Laboratory Technician Occupational Group, Senior Laboratory Technician (Office of the Chief Medical Examiner), was classified by Civil Service Commission Resolution No. 70-45 of May 4, 1970. The duties and interests of employees in this title are similar to those of the other Senior Laboratory Technicians. The City urges-that Senior Laboratory Technician (Office of the Chief Medical Examiner) should be included with the petitioned titles. We find that Laboratory Technicians, Senior Laboratory Technicians and Senior Laboratory Technicians (Office of the Chief Medical Examiner) constitute a unit appropriate for the purposes of collective bargaining. Our investigation discloses that a majority of the employees in said unit have authorized dues check-off to Petitioner. As the sole title previously covered by Certificate CWR 96/67 has been reclassified, and additional titles are being added, we-shall issue a new certification, rather than amend the former certificate.
