City, 6 OCB 78 (BOC 1970) [Decision No. 78-70 (Cert.)] OFFICE OF COLLECTIVE BARGAINING BOARD OF CERTIFICATION In the Matter of MOVING PICTURE MACHINE OPERATORS DECISION NO. 78-70 UNION, LOCAL 306, IATSE, AFL-CIO -and-DOCKET NO. RU-186-70 THE CITY OF NEW YORK D E C I S I O N A N D DIRECTION OF ELECTION Moving Picture Operators Union, Local 306, IATSE, AFL-CIO, (herein called Petitioner), filed a petition with the Office of Collective Bargaining requesting certification as the collective bargaining representative for the titles of Television Lighting Technician, Television Cameraman, and Film Editor. Petitioner later amended the petition to include the title of Assistant Television Cameraman. The City agrees that the unit sought in the amended petition is appropriate. Upon consideration of its investigation, and after due deliberation, the Board of Certification issues the following Decision and Direction of Election: I. Undisputed Matters It is undisputed, and we find and conclude, that in fact and within the meaning of the New York City Collective Bargaining Law, that Moving Picture Machine Operators Union, Local 306, IATSE, AFL-CIO, is a public employee organization. II. The Appropriate Unit Radio and Television Broadcast Engineers Union, Local 1212, IBEW, was previously certificated (CWR-47/67) by the Labor Department for the petitioned unit. However, Local 1212 now has disclaimed interest in representing these titles.

RU-186-70 2 We agree that the additional title of Assistant Television Cameraman belongs in this unit because it is classified in the same Occupational Group as the other titles, and is clearly related thereto. DIRECTION OF ELECTION By virtue of and pursuant to the power vested in the Board of Certification by the New York City Collective Bargaining Law, it is hereby DIRECTED, that as part of the investigation authorized by the Board, an election I#y secret ballot shall be conducted under the supervision of the Board of Certification or its agents, at a time, place, and during hours to be fixed by the Board, among the Assistant Television Cameramen, Television Cameramen, Television Lighting Technicians, and Film Editors employed by the City of New York and related public employers subject to the jurisdiction of the Board of Certification, who were employed during the payroll period immediately preceding the date of this Direction of Election (other than those who have voluntarily quit or who have been discharged for cause before the date of election), to determine whether or not they desire to be represented for the purposes of collective bargaining by Moving Picture Machine Operators Union, Local 306, IATSE, AFL-CIO.
