City, 6 OCB 77 (BOC 1970) [Decision No. 77-70 (Cert.)] OFFICE OF COLLECTIVE BARGAINING BOARD OF CERTIFICATION In the Matter of LOCAL 15, I.U.O.E., AFL-CIO, DECISION NO. 77-70 -and-LOCAL 246, S.E.I.U., AFL-CIO, DOCKET NO. RU-159-70 -and-THE CITY OF NEW YORK AND RELATED PUBLIC EMPLOYERS DECISION AND ORDER Local 15, International Union of Operating Engineers, AFL-CIO (herein called Petitioner), filed its petition herein on January 20, 1970, requesting certification as the collective bargaining representative of Basin Machine Operators employed by the City of New York. Upon consideration of its investigation, and after due deliberation, the Board of Certification issues the following decision: I. Undisputed Matters It is undisputed, and we find and conclude, that Petitioner is a public employee organization in fact and within the meaning of the New York City Collective Bargaining Law. II. The Appropriate Unit and Representative Status Basin Machine Operators perform work similar to that of Tractor Operators and Motor Grader Operators. All three titles require similar licenses and operate somewhat similar equipment.
DECISION NO. 77-70 DOCKET NO. RU-159-70 2 Petitioner is the certified representative, jointly, with Local 246, S.E.I.U., AFL-CIO, for Tractor Operators and Motor Grader Operators (Decision No. 50-70). Petitioner, Local 246, and the City have agreed that the petitioned title should be added to that certification. It appears from our investigation that a majority of the Basin Machine Operators have authorized dues check-off in behalf of Petitioner. Accordingly, we shall amend Certification No. 50-70 to include the petitioned title. 0 R D E R Pursuant to the powers vested in the Board of Collective Bargaining by the New York City Collective Bargaining Law, it is hereby ORDERED, that Certification No. 50-70, be, and the same hereby is, amended to include the title of Basin Machine Operator.
