City, 6 OCB 73 (BOC 1970) [Decision No. 73-70 (Cert.)] OFFICE OF COLLECTIVE BARGAINING BOARD OF CERTIFICATION In the Matter of DISTRICT COUNCIL 37, AFSCME, DECISION NO. 73-70 AFL-CIO -and-DOCKET NO. RU-175-70 THE CITY OF NEW YORK DECISION AND ORDER On March 13, 1970, District Council 37, AFSCME, AFL-CIO, filed its petition herein, requesting that the newly created titles of Supervisor II (Training) and Supervisor III (Training) be added by accretion to Certification CWR-70/67, covering various non-professional, supervisory, social service and related titles. Upon consideration of its investigation, and after due deliberation, the Board of Certification issues the following decision: I. Undisputed Matters It is undisputed, and we find and conclude, that Petitioner is a public employee organization, in fact and within the meaning of the New York City Collective Bargaining Law.

The Appropriate Unit and Representative Status Petitioner originally sought to add the petitioned titles to an existing unit of various non-professional supervisory social service and related titles (CWR-70/67, as amended by Decisions 50-69, 67-69, 71-69, and 47-70). The petitioned titles, however, are professional, since they require a master's degree in social work. In this respect, they properly belong in certification CWR-69/67, which includes the titles of Social Worker, Supervisor I (Social Work), Supervisor II (Social Work), Supervising Children's Counselor, and Principal Children's Counselor. The City and the Union consent to the addition of the petitioned titles to CWR-69/67. As the petitioned titles were created in 1969, while CWR-69/67 was issued in 1967, accretion is appropriate. 0 R D E R Pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining Law, it is hereby
