Cert.)] OFFICE OF COLLECTIVE BARGAINING BOARD OF CERTIFICATION In the Matter of CITY EMPLOYEES UNION, DECISION NO. 57-70 LOCAL 237, I.B.T -and-DOCKET NO. RU-116-70 THE CITY OF NEW YORK and RELATED PUBLIC EMPLOYERS ORDER AMENDING CERTIFICATION On June 5, 1970, City Employees Union, Local 237, I.B.T., filed its petition herein, requesting that the newly established title of Housing Maintenance Helper be added to Certificate CWR-1-9/67 covering Maintenance Men. Upon consideration of its investigation, and after due deliberation, the Board of Certification issues the following decision: I. Undisputed Matters It is undisputed, and we find and conclude, that Petitioner is a public employee organization in fact and within the meaning of the New York City Collective Bargaining Law,. II. The Appropriate Unit and Representative Status In Decision No. 12-70, the Board considered and rejected Petitioner's contention that the newly established title of Housing Maintenance Helper should be included in a bargaining unit with Maintenance Men., noting, in part, as follows: "The job title Housing Maintenance Helper' is unique to the Housing Authority; it is not found in any mayoral or municipal agency. There are no incumbents in the title and the position is transient, for training purpose, not permanent. It was established to designate those employees in the title of Housing Caretaker who are selected for training as Maintenance Men. At the end of the training period, those employees are either promoted to Maintenance Men, or revert to their permanent title of Housing Caretaker."
DECISION NO, 57-70 DOCKET NO. RU-116-70 2 In view of the fact that the title Housing Maintenance Helper designates trainees who come from, and if unsuccessful revert to, the title of Housing Caretaker, we find that the interests, duties and skills of Housing Maintenance Helpers are closely related to those of Housing Caretakers and other titles covered in Petitioner's certifications heretofore merged and consolidated by Decision No. 62-69. Under the circumstances, and since Housing Maintenance Helper is a newly created title, it may properly be accreted to that certified unit (Matter of Local 384, District Council 37, AFSCME, Decision No. 39-69; Matter of District Council 37, AFSCME, AFL-CIO, Decision No, 42-70). 0 R D E R Pursuant to the powers vested in the Board of Collective Bargaining by the New York City Collective Bargaining Law, it is hereby 0 R D E R E D , that Certification No. 62-69, be, and the same hereby is, amended to include the title Housing Maintenance Helper.
