City, 6 OCB 26 (BOC 1970) [Decision No. 26-70 (Cert.)] OFFICE OF COLLECTIVE BARGAINING BOARD OF CERTIFICATION In the Matter of DISTRICT COUNCIL 37, AFSCME, AFL-CIO DECISION NO. 26-70 -and-DOCKET NO. RU-138-69 THE CITY OF NEW YORK DECISION AND CERTIFICATION On September 17, 1969, District Council 37, AFSCME, AFL-CIO, filed its petition herein, requesting that Principal Rent Examiners be added to Certificate CWR-59/67 (as amended by Decision No.51-69) covering Senior Rent Examiners, Supervising Rent Inspectors, Senior Rent Examiners, and Supervising Rent Examiners employed by the City of New York. The Office of Labor Relations initially objected to this petition on the ground that the petitioned employees are managerial, but subsequently withdrew its objection. Upon consideration of its investigation, and after due deliberation, the Board of Certification issues the following decision: I. Undisputed Matters It is undisputed, and we find and conclude, that Petitioner is a public employee organization in fact and within the meaning of the New York City Collective Bargaining Law.

The Appropriate Unit and Representative Status Petitioner was certified by the New York City Department of Labor, in 1967, as representative of a unit consisting of Senior Rent Inspectors, Senior Rent Examiners and Supervising Rent Examiners (CWR No.59/67). The Board of Certification, in 1969, added Supervising Rent Inspectors thereto (Decision No.51-69). Incumbents of the petitioned r-itle perform work similar to that of the previously certified employees. The petitioned title is classified in the same occupational group as the previously certified titles and is in direct line of promotion from Supervising Rent Examiner. It is clear from the foregoing, and we find, that the duties, skills, and interests of Principal Rent Examiners are closely related and allied to those of the employees covered in Certificate CWR-59/67, as amended by Decision No.51-69. Our investigation discloses that a majority of the Principal Rent Examiners have authorized dues check-off in behalf of Petitioner. Accordingly, we shall add the petitioned title to Certificate CWR-59/67, as amended by Decision No.51-69.
