RU-1176a-95 AND RELATED PUBLIC EMPLOYERS : - - - - - - - - - - - - - - - - - X DECISION AND ORDER District Council 37, AFSCME filed a motion pursuant to Rule 1-02(s), on April 25, 1995, seeking to add the titles Clerical Associate Levels I - IV and Secretary Level I - IV to Certificate No. 46C-75. On June 9, 1995 Communications Workers of America Local 1180 filed a motion to intervene and seeks to add the title Clerical Associate Levels III and IV to Certificate No. 41-73. On June 23, 1995 petitioner, DC 37, filed a motion to sever that portion of the petition not subject to Local 1180's motion to intervene. Intervenor, Local 1180, did not oppose petitioner's motion to sever. In Decision No. 17-95 the motion to amend was severed and a hearing was ordered on the issue of unit placement of the title Clerical Associate Levels III and IV. On March 6, 1996 Communications Workers of America Local 1180 withdrew the motion to intervene. The respondent having offered no objection to District Council 37's petition and it appearing to the satisfaction of the Board that the title should be added to Certification No. 46C-75 (as amended), covering various clerical titles;

Docket No. RU-1176a-95 ORDER NOW, THEREFORE, pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining Law, it is hereby ORDERED that Certification No. 46C-78 (as previously amended) be, and the same hereby is, further amended to include the title Clerical Associate Levels III and IV, subject to existing contracts, if any.
