(Official decision follows.) ____________________________________________________________ OFFICE OF COLLECTIVE BARGAINING BOARD OF CERTIFICATION In the Matter of the Certification Proceeding -between- THE ORGANIZATION OF STAFF ANALYSTS, Petitioner, -and- THE NEW YORK CITY HEALTH AND HOSPITALS CORPORATON, Respondent, -and- DISTRICT COUNCIL 37, AFSCME, AFL-CIO, Intervenor. ____________________________________________________________ ORDER AMENDING CERTIFICATION On June 27, 2011, the Organization of Staff Analysts (“OSA”) filed a petition pursuant to § 1-02(u) of the Rules of the Office of Collective Bargaining (Rules of the City of New York, Title 61, Chapter 1) requesting that the title Addiction Program Administrator (Title Code No. 00056F) be accreted to Certification No. 3-88, a bargaining unit that includes such titles as Senior Health Care Program Planner Analyst, Senior Systems Analyst, Supervising Systems Analyst, Systems Analyst (Approved
5 OCB2d 7 (BOC 2012) 2 Specialties), and Systems Project Leader (EDP). District Council 37, AFSCME, AFL-CIO (“DC 37”) filed a motion to intervene seeking to add the title to Certification No. 37-78, a bargaining unit that includes social services titles, such as Addiction Counselor and Alcoholism Counselor. Notice of this petition was given to the New York City Health and Hospitals Corporation and the public. OSA subsequently withdrew interest in the title. The Board of Certification is satisfied that no evidence was presented to rebut DC 37’s assertion that Addiction Program Administrators have a sufficient community of interest with the members of its bargaining unit. NOW, THEREFORE, pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining Law (New York City Administrative Code, Title 12, Chapter 3), it is hereby ORDERED that Certification No. 37-78 (as previously amended) be, and the same hereby is, further amended to add the title Addiction Program Administrator (Title Code No. 00056F), subject to existing contracts, if any.
