5 OCB2d 12 (BOC 2012) 2 International Brotherhood of Teamsters, Local 237 (“Local 237”) represents Supervisor of Traffic Device Maintainers Level I (Title Code No. 90904) in Certification No. 67-78. See Office of Mun. Labor Relations, 30 OCB 50 (BOC 1982). Notice of this petition was provided to the public, OSA, and Local 237, and no objections were filed. Our investigation shows that there are incumbents serving in the title Supervising Superintendent of Maintenance. These employees will be reclassified to two new assignment levels of the existing title Supervisor of Traffic Device Maintainers. In order not to deprive these employees of union representation, this Board will delete the title Supervising Superintendent of Maintenance upon notification by the City that the title is vacant. See OSA, 4 OCB2d 40 (BOC 2011). NOW, THEREFORE, pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining Law (New York City Administrative Code, Title 12, Chapter 3), it is hereby ORDERED that Certification No. 3-88 (as previously amended) be, and the same hereby is, amended to add Supervisor of Traffic Device Maintainers Levels II and III (Title Code No. 90904), subject to existing contracts, if any; and it is ORDERED that Certification No. 3-88 (as previously amended) be further amended to delete the title Supervising Superintendent of Maintenance (Title Code No. 91350) when it becomes vacant.
