RU-1076-90 THE CITY OF NEW YORK and RELATED PUBLIC EMPLOYERS ------------------------------ x DECISION AND ORDER CONSOLIDATING CERTIFICATIONS On October 17, 1990, Local 246, Service Employees International Union, AFL-CIO, filed its petition herein, requesting the consolidation of the following certifications: Certification No. 7-70 (as amended) Sheet Metal Worker Supervisor-Sheet Metal Worker. Certification No. 54-70 (as amended) Various automobile machinists, mechanics, and related titles. Notice of this petition was published in The City Record on October 29, 1990, and notices were posted on the bulletin boards of the agencies which the affected employees serve. No objections or interventions have been filed. The City's Office of Labor Relations, by letter dated February 5, 1991 states that it "will not contest" Local 246's petition to consolidate the certifications. Our investigation shows that such a consolidated unit would be appropriate for collective bargaining purposes (and that a
Decision No. 4-91 2 Docket No. RU-1076-90 majority of the employees in the combined unit have authorized dues check-off in behalf of Local 246, S.E.I.U.). Moreover, the history of bargaining for these certificates indicates that all positions have been bargained for together by Local 246, S.E.I.U. and are covered by a single agreement between the City and Local 246. We find no reason not to combine the two certificates in a single unit where there has been no objection and a de facto single unit has existed for at least two contract periods since July 1, 1984. ORDER NOW, THEREFORE, pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining Law, it is hereby ORDERED that Certification No. 7-70 (as amended) and Certification No. 54-70 (as amended) be, and the same hereby are, combined and consolidated so as to constitute one bargaining unit (to be cited by the present Decision Number), consisting of the titles set forth in the Appendix to this order; an it is hereby
