RU-1008-88 RU-1011-88 -and-THE CITY OF NEW YORK ------------------------------- x DECISION AND ORDER These applications request, in the aggregate, that Certification No. 37-78 * (as previously amended) be further amended by adding the new title of Senior Social Worker (HCF) and by substituting the new title of Sanitation Compliance Agent for the obsolescent title of Compliance Agent (Sanitation). District Council 37 further requests that the latter title "not be eliminated until it becomes vacant so as to protect any incumbents during a transition period." The Office of Municipal Labor Relations states that it does not oppose the accretion of the two new titles to Certification No. 37-78 (as amended), but it has not stated its position with regard to the deletion of the * This Certification covers various social service and related titles, including Social Worker.

Our investigation shows that the title of Senior Social Worker (HCF) is appropriate for inclusion in this unit, that the title of Sanitation Compliance Agent replaces that of Compliance Agent (Sanitation), but that there may still be incumbents in the latter title. Accordingly, we shall grant Petitioner's requests in their entirety. ORDER NOW, THEREFORE, pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining Law, it is hereby ORDERED that Certification No. 37-78 (as previously amended) be, and the same hereby is, further amended to include the titles of Senior Social Worker (HCF) and Sanitation Compliance Agent, subject to existing contracts, if any; and it is further ORDERED that the title of Compliance Agent (Sanitation) be deleted from the cited Certification when it becomes vacant.
