RU-963-86 - - - - - - - - - - - - - - - - - X DECISION AND ORDER On May 8, 1986 ,Doctors' Council filed a petition requesting the addition of the titles of Staff Physician (Correction) and Deputy Chief Medical Examiner (O.C.M.E.) to Certification No. 50-73 (as amended), covering some fifty medical and related titles. The City's Office of Municipal Labor Relations opposed this petition on the grounds that Deputy Chief Medical Examiner was managerial and that Staff Physician (Correction) was not a classified title and would be affected by a reorganization then in progress of the health services of the Department of Correction. Petitioner requested a hearing on the City's objections, which was ordered by the Board. The hearing was adjourned at the request of the parties in order to permit them to arrive at a settlement of this matter. The parties finally entered into a written stipulation (later amended by exchange of letters, to correct the nomenclature of the civil service title involved) providing, inter alia, that Petitioner would withdraw, with prejudice, the petition for Staff Physician (Correction) and

Deputy Chief Medical Examiner (O.C.M.E.), while the City consented to the addition of the new, Non-Competitive title of Associate Chief City Medical Examiner to Certification No. 50-73 (as amended). As this title appears to 13e a successor to the Competitive title of Associate Medical Examiner (O.C.M.E.), which is included in the cited Certification, the Board approves the stipulation. 0 R D E R NOW, THEREFORE, pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining Law, it is hereby ORDERED that Certification No. 50-73 (as previously amended) be, and the same hereby is, further amended to include the title of Associate Chief City Medical Examiner, subject to existing contracts, if any.
