RU-978-86 -and-THE CITY OF NEW YORK ----------------------------------x DECISION AND ORDER The petition herein, as amended, requests that the new title of Assistant City Highway Repairer be added to Certification No. 38B-78 (as amended), covering various non-supervisory custodial, maintenance, and related titles. The petition also requests that the title of Assistant Highway Repairer be deleted from this Certification on the ground that "the City Personnel Director intends to discontinue use of the [latter title] in favor of the new title ...” The City's office of Municipal Labor Relations has no objection to the accretion of the new title to this Certification but has not stated its position with regard to the deletion of the allegedly obsolescent title. Our investigation confirms Petitioner's allegations. Accordingly, we shall add the new title to Certification No. 38B-78 (as amended) and order the deletion therefrom of the obsolescent one when it becomes vacant.

ORDER NOW, THEREFORE, pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining Law, it is hereby ORDERED that Certification No. 38B-78 (as previously amended) be, and the same hereby is, further amended to include the title of Assistant City Highway Repairer, subject to existing contracts, if any; and it is further ORDERED that the title of Assistant Highway Repairer be deleted from the cited Certification when it becomes vacant.
