RU-955B-86 -and-THE CITY OF NEW YORK ----------------------------------x CLARIFICATION OF DECISION On May 20, 1986, we issued our Decision No. 2-86 herein, which substituted the new title of Associate Retirement Benefits Examiner for the reclassified titles of Retirement Benefits Examiner, Retirement Benefits Counselor, and Supervising Retirement Benefits Examiner in Certification No. 46D-75 (as amended). By letter dated July 9, 1987, the Union requested clarification of that Decision, pointing out that the title of Retirement Benefits Examiner was not vacant, and requesting that the title be restored to the certification. By letter dated July 16, 1987, the City's Office of Municipal Labor Relations agrees that the title "should be restored to the appropriate certificate if [it] is not vacant."
DECISION NO. 13-87 DOCKET NO. RU-955B-86 2. Our investigation confirms that there are incumbents in the title and shows, moreover, that it has been retained in the Classified Service "for present permanent incumbents...". Therefore, since it was the Board's intent to delete only vacant and obsolete titles, it is hereby ORDERED that the title of Retirement Benefits Examiner be, and the same hereby is, restored to Certification No. 46D-75 (as amended).
