Summary of Decision: The City of New York sought to amend Civil Service Technical Guild, Local 375, District Council 37’s Certification No. 26-78 to add the title Supervisor of Building Installations and Maintenance and to delete the titles Supervisor of Electrical Installations and Maintenance and Supervisor of Mechanical Installations and Maintenance to reflect the reclassification of these titles. The Board added the new title and held that the predecessor titles will be deleted when vacant. (Official decision follows.) ____________________________________________________________ OFFICE OF COLLECTIVE BARGAINING BOARD OF CERTIFICATION In the Matter of the Certification Proceeding -between- THE CITY OF NEW YORK, Petitioner, -and- CIVIL SERVICE TECHNICAL GUILD, LOCAL 375, DISTRICT COUNCIL 37, AFSCME, AFL-CIO, Respondent. ____________________________________________________________ ORDER AMENDING CERTIFICATION On July 13, 2011, the City of New York (“City”) filed a motion to amend Certification No. 26-78, a bargaining unit represented by the Civil Service Technical Guild, Local 375, District Council 37 (“Union”), to add the title Supervisor of Building Installations and Maintenance, Levels I, II, III, and IV (Title Code No. 34222) and to delete the titles Supervisor of Electrical Installations and Maintenance, Levels I and II (Title Code No. 34205), and Supervisor of Mechanical Installations and Maintenance,

Notice of this motion was provided to the public and the Union, and no objections were filed. Our investigation shows that there are incumbents serving in the titles Supervisor of Electrical Installations and Maintenance and Supervisor of Mechanical Installations and Maintenance. These employees will be moved to the title Supervisor of Building Installations and Maintenance after the Union is certified to represent that title. In order not to deprive these employees of union representation, this Board will delete the titles Supervisor of Electrical Installations and Maintenance and Supervisor of Mechanical Installations and Maintenance upon notification by the City that the titles are vacant. See DC 37, 3 OCB2d 20 (BOC 2010). NOW, THEREFORE, pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining Law (New York City Administrative Code, Title 12, Chapter 3), it is hereby ORDERED that Certification No. 26-78 (as previously amended) be, and the same hereby is, amended to add the title Supervisor of Building Installations and Maintenance, Levels I, II, III, and IV (Title Code No. 34222), subject to existing contracts, if any; and it is ORDERED that Certification No. 26-78 (as previously amended) be further amended to delete the titles Supervisor of Electrical Installations and Maintenance, Levels I and II (Title Code No. 34205), and Supervisor of Mechanical Installations and Maintenance, Levels I, II, III, and IV (Title Code No. 34221), when those titles become vacant.
