RU-132-69 THE CITY OF NEW YORK - - - - - - - - - - - - - - - - - - - - - - x DECISION AND ORDER Social Service Employees Union, Local 371, District Council 37, AFSCME, AFL-CIO, filed its petition herein, on July 30, 1969. Upon consideration of its investigation and after due deliberation, the Board of Certification issues the following decision: I. Undisputed Matters It is undisputed, and we find and conclude, that, in fact and within the meaning of the New York City Collective Bargaining Law: Petitioner is a public employee organization; and that a question or controversy concerning representation exists. II. The Appropriate Unit Petitioner requests certification as the exclusive collective bargaining representative of a unit consisting of Teachers, employed in the Department of Correction.
Decision No.64-69 Docket No. RU-132-69 2. These Teachers presently are included in a bargaining unit of instructional employees, employed in the Department of Correction, for which Terminal Employees, Local 832, I.B.T. is the certified bargaining representative (5 NYCDL No.104). The titles included in that unit are employed only in the Department of Correction, and the unit, therefore, is City-wide. As the duties and interests of the Teachers are substantially similar to those of the other instructional personnel, we find that it would not effectuate the purposes of the statute to sever the title of TEACHER and fragmentize the established unit. Accordingly, we shall dismiss the petition. 0 R D E R By virtue of and pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining Law, it is hereby, 0 R D E R E D, that the petition filed herein, on July 30, 1969, by the Petitioner, be, and the same hereby is, dismissed.
