RU-30-68 THE CITY OF NEW YORK ---------------------------------x DECISION AND AMENDMENT OF CERTIFICATION On April 22, 1968, Local 1219, District Council 37 herein called Petitioner, filed a petition with the Office of Collective Bargaining requesting certification as the exclusive collective bargaining representative of employees in the titles of Relocation Aide and Relocation Assistant, "employed by the Department of Relocation and Management Services (formerly Department of Relocation). I. Undisputed Matters It is undisputed, and we find and conclude, that Petitioner is a public employee organization in fact and within the meaning of the New York City Collective Bargaining Law. II. The Appropriate Unit and Representative Status The requested titles were established on January 21, 1969, by Personnel Order No. 8/69. Relocation Aides, under direction of professional staff, perform work of ordinary difficulty and responsibility in residential relocation, serve as informational aides, and assist Real Estate Managers. Relocation Assistants, under direct supervision of Project Directors or Supervising Real Estate Managers, perform ordinary duties of Relocation Aides in more difficult, special or more highly sensitive areas. Their work and interests are closely related to those of Real Estate Managers, for whom District Council 37, AFSCME, AFL-CIO, is the certified collective bargaining representative (CWR #56-67).
DECISION NO. 5-69 DOCKET NO. RU-30-68 2 Both Petitioner and the City assert that Relocation Aides, Relocation Assistants, and Real Estate Managers are not supervisory employees. Our investigation establishes' that a majority of the Relocation Aides and Relocation Assistants have authorized dues checkoff in favor of Petitioner. Accordingly, we shall amend Certificate CWR#56-67 to include the titles of Relocation Aide and Relocation Assistant. 0 R D E R Pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining Law, it is hereby 0 R D E R E D-, that Certification CWR #56-67 previously issued to District Council 37, AFSCME, AFL-CIO, be, and the same hereby is, amended to include the titles of Relocation Aide and Relocation Assistant.
