RU-75-68 -and-THE CITY OF NEW YORK - - - - - - - - - - - - - - - - - - - x DECISION AND AMENDMENT OF CERTIFICATION On October 28, 1968, District Council 37, herein called Petitioner, filed a petition with the Office of Collective Bargaining, requesting certification as the exclusive collective bargaining representative of employees in the titles of Clerk (Community Action Activities) and Stenographer (Law). I. Undisputed Matters It is undisputed, and we find and conclude, that Petitioner is a public employee organization in fact and within the meaning of the New York City Collective Bargaining Law. II. Appropriate Unit Petitioner requests that the cited titles be added to the City-wide unit of non-supervisory clerical and related titles for which Petitioner is the certified collective bargaining representative (CWR No. 52-67). The City has consented thereto and no other union has sought to intervene herein. CWR No. 52-67 (as amended by Decisions Nos. 30-68 and 44-68) consists of 46 non-supervisory clerical and related titles, encompassing nearly 20,000 employees. The titles here concerned were created in 1967 and 1968. There are about 60 employees in the requested titles. Clerks (Community Action Activities) perform "clerical work of ordinary difficulty and responsibility" in the Human Resources Administration and Stenographers (Law) take and transcribe "dictation involving the frequent use of legal terminology" in the Law Department. The wage rates for both titles are within the range of other titles included in CWR No. 52-67.

RU-75-68 2 It is clear from the foregoing, and we find, that the duties, skills, and interests of the Clerks (Community Action Activities) and Stenographers (Law) are closely related and allied to those of the employees in the non-supervisory clerical unit, and that this title properly _ should be placed in, and accreted to, that unit (Matter of District Council 37, A.F.S.C.M.E. Decision No. 44-68). Accordingly, we shall amend Certificate C"IR No. 52-67 to include the cited titles'. AMENDED CERTIFICATION Pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining Law, it is hereby 0 R D E R E D that Certificate CWR No. 52-67 (as amended by Decisions Nos. 30-68 and 44-GS) be, and the same hereby is, further amended to include the titles of Clerk (Community Action Activities) 'and Stenographer (Law).
