RU-936-85 THE CITY OF NEW YORK AND RELATED PUBLIC EMPLOYERS -------------------------------- x DECISION AND ORDER On April 12, 1985, Civil Service Technical Guild, Local 375, District Council 37, AFSCME, AFL-CIO, filed its motion herein, pursuant to ยง2.19 of the Revised Consolidated Rules of the office of Collective Bargaining, to delete the titles of Urban Technician, Planner, Principal Planner, Deputy Director of Planning, Urban Designer Trainee, and Principal Urban Designer from Certification 26-78 (as amended), covering various engineering and related titles; and to add the titles of City Planning Technician, City Planner, Associate City Planner, and Associate Urban Designer, in order to reflect the recent reclassification of these titles. The title of Deputy Director of Planning is not included in this or any other certification and will not, therefore, be further treated heroin. The City's Office of Municipal Labor Relations, in a letter dated May 1, 1985, states that it has no objection to
Decision No. 4-85 2 Docket No. RU-936-85 the requested additions and deletions (with the exception of the Deputy Director title) "where there are no longer any present incumbents." Our investigation shows that, although the titles sought to be deleted from certification were officially deleted from the Classified Service by Personnel Director's resolution No. 85-3 on January 30, 1985, there are still incumbents serving in all of these titles except Urban Designer Trainee. In order not to deprive these employees of union representation, we shall delete their titles when they become vacant. ORDER NOW, THEREFORE, pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining Law, it is hereby ORDERED that Certification No. 26-78 (as previously amended) be, and the same hereby is, further amended to include the titles of City Planning Technician, City Planner, Associate City Planner, and Associate Urban Designer, subject to existing contracts, if any; and it is further ORDERED that the title of Urban Designer Trainee be deleted from the cited Certification and that the titles of
