RU-908-84 -and-The City of New York ------------------------------ X DECISION AND ORDER On April 18, 1984, Superior Officers Association of the New York City Housing Authority Police filed this petition, requesting that the Board of Certification add the "Chief Surgeon, New York City Housing Police Dept." to its Certification 7 NYC DL No.3, presently covering the titles of Housing Sergeant, Housing Lieutenant, and Housing Captain. The petition also requests that the three certified titles be changed, respectively, to Sergeant, NYC Housing Authority Police Department (hereinafter "NYC HA PD"); Lieutenant, NYC HA PD; and Captain, NYC HA PD, "including details such as Deputy Inspector and Inspector", in order to reflect the current nomenclature of these titles. The Office of Municipal Labor Relations has not replied to our request for its position in this case. Our investigation shows that there is no such title as Chief Surgeon, New York City Housing Police Dept. The closest title used by the Housing Authority is Medical Specialist (HA), which is not a "uniformed" title. It is well settled that the

RU-908-84 Board will not find mixed units containing both members of a uniformed service and non-uniformed employees. * Accordingly, we shall deny this portion of the petition. In regard to the remainder of the petition, Petitioner's request corresponds to the current and accurate nomenclature of the unit titles, so we shall grant so much of the petition as seeks to reflect the correct nomenclature. The "details" of Captains, on the other hand, were not specified in the Certification sought to be amended, and we see no reason to list them here. This question may properly be raised in a petition concerning the inclusion in the unit or exclusion therefrom of specific "details". O R D E R Pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining Law, it is hereby ORDERED that so much of the petition herein as concerns the Chief Surgeon, NYC HA PD be, and the same hereby is, denied; and it is further ORDERED that Certification 7 NYC DL No. 3 be, and the same hereby is, amended by changing the titles of Housing Sergeant, * Decisions 31-73, 25-71, and 20-71.
