DC37 v. City, Related Public Employers,34 OCB 8 (BOC 1984) [8-84 (Cert.)] OFFICE OF COLLECTIVE BARGAINING BOARD OF CERTIFICATION ------------------------------- X In the Matter of DISTRICT COUNCIL 37, AFSCME, AFL-CIO DECISION NO. 8-84 -and-DOCKET NOS. RU-906-84 THE CITY OF NEW YORK AND RELATED RU-907-84 PUBLIC EMPLOYERS ------------------------------- X DECISION AND ORDER These petitions, filed by District Council 37, AFSCME, AFL-CIO, request, in the aggregate, that the Board add Paralegal Aides, Level II; Stenographer/Secretaries, Level III; and Stenographic/Secretarial Associates, Level II, to Certification No. 46C-75 (as amended). This Certification covers nearly a hundred clerical and related titles, including Paralegal Aide, Stenographer/Secretary, and Stenographic/Secretarial Associate. The City's Office of Municipal Labor Relations objects to these petitions on the ground that "the Union has already been duly certified as the exclusive representative for the subject titles." We agree. The Certification does not specify Assignment Levels for these titles, so it is deemed to include all such Levels. We recognize that unusual circumstances sometimes require us to place Assignment Levels of the same title in different collective bargaining units, but in the absence of such circumstances and where Levels are not specifically listed in our
DECISION NO. 8-84 2 DOCKET NOS. RU-906-84 RU-907-84 Decisions, all Assignment Levels are generally subsumed under the title listing. Accordingly, we shall dismiss these petitions. O R D E R Pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining Law, it is hereby ORDERED that the Petitions herein be, and the same hereby are dismissed.
