Of Nurses/UFT,30 OCB 12 (BOC 1982) [12-82 (Cert.)] OFFICE OF COLLECTIVE BARGAINING BOARD OF CERTIFICATION -------------------------------------X In the Matter of THE CITY OF NEW YORK AND RELATED PUBLIC EMPLOYERS -and-NEW YORK STATE NURSES ASSOCIATION DECISION NO. 12-82 DOCKET NO.: RE-126-82 -and-LEAGUE OF REGISTERED NURSES, DISTRICT 1199, NATIONAL UNION OF HOSPITAL AND HEALTH CARE EMPLOYEES, RWDSU, AFL-CIO -and-FEDERATION OF NURSES/UFT -------------------------------------X DECISION AND ORDER On January 29, 1982, the Office of Municipal Labor Relations, on behalf of the City of New York and the New York City Health and Hospitals Corporation, filed a timely petition, requesting that the Board of Certification designate as managerial and/or confidential the employees in various titles, including Supervisor of Nurses. The latter title is part of a unit for which a representation petition (Docket No. RU-858-82) was filed by League of Registered Nurses, District 1199, National Union of Hospital and Health Care Employees, RWDSU, AFL-CIO. Timely interventions were filed in both cases by Federation of Nurses/UFT and New York State Nurses Association.
Decision No. 12-82 2 Docket No. RE-126-82 At a meeting of all of the parties, held on March 30, 1982, it was agreed that, in order to avoid delay in the election in Case No. RU-858-82, the office of Municipal Labor Relations would apply to withdraw the title of Supervisor of Nurses from its petition in RE-126-82, without prejudice to the filing of a petition raising the same question at any time after final resolution of the representation issue in Case No. RU-858-82. On April 5, 1982, the office of Municipal Labor Relations made such a request, which we shall grant. ORDER Pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining Law it is hereby ORDERED that the Citys request to withdraw the title of Supervisor of Nurses from its petition in Case No. RE-126-92 be, and the same hereby is, granted, without prejudice to the filing of a petition raising the same question at any time after final resolution of the representation question in Case No. RU-858-82.
