RU-803-81 - and THE CITY OF NEW YORK ------------------------------------------x DECISION AND ORDER On March 6, 1981, Uniformed Firefighters Association (herein UFA) requested an amendment of its Certification 1 NYC DL No.2 (as amended by Decision No. 61-70) in order to reflect the change of name of that organization from "Uniformed Firefighters Association of Greater New York, Local 94, I.A.F.F., AFL-CIO" to "Uniformed Firefighters Association". This certification covers employees in the titles of Fireman and Fire Marshal (Uniformed). The affirmation of Nicholas Mancuso, president of the Union, which was submitted in support of the request, recites that pursuant to Article XII, Section 2 of the International Association of Firefighters Constitution, the membership of Local 94, IAFF has voted to voluntarily forfeit the IAFF charter, by a majority vote of the entire membership conducted in a secret ballot referendum, after thirty (30) days written notice had been given to the entire membership such a proposal would be submitted. Also submitted in support of this request were copies of the following: “(l) Article 12, Section 2 of the IAFF Constitution, as amended;

(2) the resolution upon which UFA members voted to voluntarily forfeit the IAFF Charter; (3) letters notifying the IAFF and the AFL-CIO concerning the vote to voluntarily forfeit the IAFF Charter; and (4) a certification by James Boyle, UFA Financial and Recording Secretary, concerning the results of the vote of the UFA." Notice of this application was published in The City Record on March 19, 1981, and posted on the Board's public docket as well as on appropriate employee bulletin boards. No objections have been received. The City's Office of Municipal Labor Relations, in a letter dated April 9, 1981, states that it has no objection to the requested change. Therefore, we shall grant the request. This amendment is not, however, to be considered as a new certification or a recertification. ORDER Pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining Law, it is hereby ORDERED that Certification 1 NYC DL No. 2 (as previously amended) be, and the same hereby is, further amended so as to change the name of the certified representative therein to "Uniformed Firefighters Association", subject to existing contracts, if any.
