RU-801-81 RU-805-81 NATIONAL ASSOCIATION OF BROADCAST EMPLOYEES AND TECHNICIANS, LOCAL 15, AFL-CIO -and-THE CITY OF NEW YORK AND RELATED PUBLIC EMPLOYERS ----------------------------------------X DECISION AND ORDER On February 5, 1981, Local 306, IATSE (herein IATSE), filed its petition (RU-801-81) herein, seeking to add the new title of Video Project Director to Certification No. 63-75, presently covering employees in the titles of Motion Picture Operator, Audio-Visual Aid Technician, and Senior Audio-Visual Aid Technician (herein Sr. AVAT). On March 23, 1981, National Association of Broadcast Employees and Technicians, Local 15 (hereinafter NABET), filed its petition (RU-805-81) herein, seeking certification as exclusive collective bargaining representative of a separate unit of Video Project Directors. The Office of Municipal Labor Relations, on behalf of the City of New York and the Offices of the District Attorneys in the City of New York, opposes NABET's petition on the ground that
Decision No. 13-81 Docket Nos. RU-801-81 2 RU-805-81 it seeks "the creation of an additional bargaining unit composed of less than a dozen employees." (Petitioners allege that there are four or five employees in the requested title, while the Board's investigation shows only one or two, with a probable increase to four in the foreseeable future.) The City also points out that IATSE's petition "would result in the accretion of this title to an already existing and appropriate bargaining unit." The objection to the NABET petition raised by the City is both valid and significant. Moreover, the new title of Video Project Director is classified in the same Occupational Group as all three titles in Certification No. 63-75, is in a direct line of promotion from Sr. AVAT and performs similar duties at a higher level. In fact, the authorization cards submitted by NABET in support of its petition were all, with one exception, signed by Sr. AVAT's. Accordingly, all the requirements for accretion having been satisfied, we shall grant IATSE's petition and deny NABET's. 0 R D E R NOW, THEREFORE, pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining Law, it is hereby ORDERED that the petition filed by NABET in RU-805-81 be, and the same hereby is denied; and it is further
