RU-789-80 THE CITY OF NEW YORK AND RELATED PUBLIC EMPLOYERS ----------------------------------x DECISION AND ORDER On September 3, 1980, District Council 37, AFSCME, AFL-CIO, filed its petition herein, seeking to add the title of Employee Assistance Counselor (OTB) to Certification No. 37-78 (as amended), covering various social service and related titles. The City's Office of Municipal Labor Relations, which had originally opposed this petition on the ground of "this title's confidential status," has now withdrawn its objection. As there is no longer any dispute regarding the status of the employee in this title, and because it appears to the satisfaction of the Board that the requested unit is appropriate, and that the one Employee Assistance Counselor (OTB) has authorized check-off of dues in behalf, of Petitioner, we shall grant the petition.
2 Decision No. 12-81 Docket No. RU-789-80 0 R D E R NOW, THEREFORE, pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining Law, it is hereby ORDERED that Certification No. 37-78 (as previously amended) be, and the same hereby is further amended to include the title of Employee Assistance Counselor (OTB), subject to existing contracts, if any.
